The Folk Legal Culture of the Cebuano Filipino (G.
Sidney Silliman). - The roots of the Philippine national legal
system do not run deep. Much of the rural population of the
archipelago does not share in the emphasis of the national
legal culture on procedural justice. In addition, the Western-
style courts are only one among a variety of mechanisms by
which people in the lowlands process their disputes. For the
peasant population in particular, courts are to be avoided
owing to the widespread belief that the elite classes have a
distinct advantage in such institutions. A desire for justice
through a court-rendered decision is the least common
motive of litigants. Moreover, it is not uncommon for a
conflict to continue in other forms even after judgment has
been rendered by a court. It appears, therefore, that legal folk
culture needs to be specified if we are to accurately
understand dispute processing in the Philippines. For the
rural Cebuano justice means, first of all, fairness in both the
process of settling disputes and in the results achieved by
such settlements, and this in an equal manner for all the
members of the various social classes. Furthermore, justice
means that dispute resolution should be relatively quick and
mexpensive and, in particular, that conflicts should be settled
by means of husay (mediation). When articulating their
preference for husay, respondents will often explain that
court cases, in contrast to husay, involve expenditures of time
a nd money. Husay is also seen as enhancing the likelihood
that the disputants will return to an amicable relationship.
Finally, justice incorporates the recognition of certain
fundamental rights, of which the right to one’s self or one’s
°wn, and the right to one’s work or one’s livelihood are
principal. There is a pervasive belief that the Philippine legal
s ystem does not provide justice in those terms. Justice, from
the perspective of the rural Cebuano, is only possible when

Vater und Mutter. Aspekte der Gottesvorstellung im
alten Israel und ihre anthropologische wie soziologische
Relevanz (Franz Josef Stendebach). - In der Überlieferung
des Alten Testamentes erscheint Gott vorwiegend männlich.
Der Name „Vater“ für Gott nimmt aber keine zentrale
Stellung im Glauben Israels ein und wird mit spürbarer
Zurückhaltung gebraucht, nur als eines der mannigfachen
Bilder, mit denen das Verhältnis zwischen Jahwe und Israel
beschrieben wird. Der Gedanke einer physischen Zeugung
durch Gott ist ausgeschlossen. In einigen Texten werden
Jahwe aber auch mütterliche Züge zugeschrieben, was gerade
in einer so patriarchalisch strukturierten Gesellschaft bedeu
tungsvoll ist; doch ist auch mit dieser Redeweise keine
physische Verwandtschaft gemeint, sondern sie ist als Bild
für das erwählend-fürsorgende Handeln Gottes an Israel zu
verstehen. Auch in der Gestalt von „Frau Weisheit“ scheint
das weibliche Element in der Gottheit entmythologisierend
personifiziert und dem männlichen Jahwe in untergeordneter
Stellung beigesellt worden zu sein. In ihr verdichtet sich der
weiblich-mütterliche Aspekt Jahwes. In der Umwelt Israels
fanden sich Vater- und Muttergottheiten; vielfach ist auch
festzustellen, daß einer und derselben Gottheit männliche
und weibliche Züge zuerkannt wurden oder daß eine
ursprünglich weibliche Gottheit zu einer männlichen wur
de, wobei ein Wandel der sozialen Strukturen von Einfluß
sein konnte. Die Bezeichnung einer Gottheit als Vater oder
(bzw. und) Mutter muß nicht auf eine sexuelle Differenzie
rung (bzw. eine Bisexualität im strikten Sinne - die zuweilen
auch vorkommt -) gedeutet werden; vielmehr bringen diese
Bezeichnungen oft lediglich Aspekte der Gotteserfahrung
zum Ausdruck, die sich mit den Ursymbolen von Vater und
Mutter verbinden, oder sogar die Tatsache, daß die Gottheit
über den gegensätzlichen Attributen steht und mit rein
rationaler Erfahrung nicht erfaßt werden kann. Das Neue
Testament kennt keine mütterlichen Züge in Gott; damit ist
die Gefahr der Einseitigkeit gegeben, der durch Rückgriff auf
die Aussagen des Alten Testamentes begegnet werden sollte.
